General Terms and Conditions of Sale

These general conditions of sale apply to any order placed with the company Argenplast Srl on the website moranduzzo.com (“seller”) in accordance with the provisions of Leg. n. 206/2005, as amended by Leg. n. 21/2014 and by Leg. 70/2003 of the Consumer Code on e-commerce.

The legal and operational headquarters of Argenplast Srl P.Iva: 04197530480 located at Via Leonardo da Vinci 7 50028 Tavarnelle Val di Pesa (FI) Italy. Prices are in Euros including VAT.

1- Purchase at moranduzzo.com.

The purchase is made by the buyer (“customer”) by placing the products in the shopping cart, clicking buy completes the order form. The purchase is confirmed upon receipt of the order form and payment. By transmitting the order form electronically, the buyer accepts without reservation all the General Terms and Conditions of Sale on this page and the exchange of e-mail messages. The online sales contract between the customer and the seller is concluded in Italy and governed by Italian Law.

2 – Any Changes to the Order.

Any changes to the order will be accepted by sending an email to [email protected] until the product has been shipped. If the product has already been shipped, no changes to the order will be possible.

3 – Any Unavailability

The online catalog of moranduzzo.com is constantly updated. However, it may rarely happen that a product is no longer available or on its way. In this case moranduzzo.com will promptly notify the “customer” who can decide whether to make changes to the order or request a refund of the amount paid. In the case of orders consisting of more than one product, the possible unavailability of only one product entitles the customer to a refund of the amount paid for only the portion related to the unavailable product.

4 – Delivery Time

Products purchased on moranduzzo.com , if in stock, are shipped within 24 hours after the order is placed. If, on the other hand, part of the ordered goods is not in stock, written or telephone notification will be sent to the customer within 24 hours. Goods can be shipped to Italy and the rest of the world with varying costs, methods and delivery times depending on the type of shipment and destination. 6- Delivery/Receipt and Returns

Upon delivery, the customer is required to check the condition of the packaging and that the goods are undamaged. If the packaging or goods are damaged to get the product replaced, it is necessary:

– Accept subject to control the goods from the courier by writing the damage in detail on the transport document.

– Take photos of the damaged packaging or product and then send them with a description of the damage to our email address [email protected]

Shipping costs for returning damaged goods will be fully covered by the seller. Damaged goods must be repackaged with the original packaging.

8- Right of Withdrawal

The “customer” has the right to withdraw from the purchase without penalty and without specifying the reason, within the period of fourteen working days from the day of delivery. Exceptions to the right of withdrawal are products made to measure or clearly customized and those products that provide for strictly personal use such as mattresses and pillows whose casings were no longer sealed and for purchases made with a VAT number and therefore with the issuance of an invoice to a company. In addition, the goods must be returned with the original and undamaged packaging. The customer is required to return the product at his or her own expense to the seller within fourteen days of the exercise of the right of withdrawal and is responsible for any decrease in value resulting from handling other than what is necessary to establish the nature, characteristics and operation of the product. In the case of return of a product evidently damaged by the purchaser, a refund of the amount spent, reversed of the value of the damage, will be provided.

9- Warranty

The Products are guaranteed for 2 years from the date of delivery against manufacturing or material defects. During the warranty period, the seller agrees to replace or refund products deemed by him to be defective. Replaced products enjoy the warranty for the remaining period of time. Products found to be defective as a result of failure to follow assembly instructions or use not in accordance with the product’s technical specifications are excluded from the warranty.

10- Limits of Use

The seller reserves the right not to process the order by refunding the payment to the customer if there is an error in the product sheet that makes it not conform to the product description.

For example: non-availability of a product at the end of production, restyling, or major list increases not yet reflected in the product sheet.

11- Non-Compliance

The colors in the product sheet may be subject to slight variations determined by the different color performance of navigation software and/or display screens or even by different manufacturer’s sampling.

Information and features related to the Products are available, with their Product codes, on the Site.

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the Products themselves is for the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In case of any difference between the picture and the written product sheet, the description in the product sheet shall always prevail

14- Jurisdiction Forum and Competence

This contract is governed by Italian law; any dispute concerning its interpretation or execution shall be settled by the FORUM OF FLORENCE.
